Article 2 – Application of the General Terms and Conditions of Sale
These conditions apply to the sale of products by CAVE PUR JUS via its online store accessible on the website cavepurjus.com. They are automatically made available to the consumer on the homepage of the website.
The consumer may consult the General Terms and Conditions of Sale (hereinafter “GTC”) at any time by clicking on the corresponding link, even before initiating the ordering process.
Placing an order implies full and unconditional acceptance of these GTC, to the exclusion of any other documents such as brochures or catalogs issued by the seller, which are for indicative purposes only.
Failure by the seller to enforce any provision of these GTC at a given time shall not be deemed a waiver of its right to enforce such provision at a later date.
Article 3 – Ordering Process and Order Tracking

Orders are confirmed by the sending of the invoice by email but become final only upon receipt of full payment.
Article 4 – Specific Conditions: Gifts and Invoicing
When an order is intended for a third party (gift), the consumer may specify a delivery address different from the billing address. In this case, the invoice will not be included in the parcel and will be sent only by email to the purchaser.
Personalized messages to be included in the parcel may be entered during the ordering process. No prices will appear in the gift package.
Article 5 – Professional Orders
Professionals may place orders via the website or contact CAVE PUR JUS for a customized quotation. To benefit from tailored processing (discounts, bulk deliveries, specific lead times), they must provide a valid SIRET number and a professional billing address.
Specific commercial terms (pricing, payment deadlines, free shipping thresholds) may be negotiated on a case-by-case basis. In the absence of specific agreements, these GTC shall also apply to professional customers.
Article 6 – Prices
Prices are indicated in euros (€), inclusive of all taxes (VAT) where applicable, excluding shipping costs, subject to typographical or display errors. For non-EU countries, prices are invoiced exclusive of VAT. Prices are payable at the time of order.
- Deliveries within mainland France and Corsica: prices include French VAT and duties.
- Deliveries within the EU or other countries: shipping costs, customs duties, taxes, and any other formalities are borne exclusively by the consumer and may be payable to the carrier upon delivery.
CAVE PUR JUS reserves the right to modify prices at any time. However, the price displayed on the catalog on the date of order validation shall be the only price applicable to the consumer.
Article 7 – Availability
In the event of unavailability, the consumer will be informed within 24 hours. The remaining items will be shipped at our expense or refunded within 48 hours. Refunds will be made using the same payment method as the original transaction.
Article 8 – Delivery
8.1 – Conditions
Products are delivered exclusively to adults. At delivery, the consumer may be required to present proof of age in accordance with applicable law.
8.2 – Delivery Times
Delivery is carried out by a carrier. Delivery times vary depending on the delivery method and destination and begin upon receipt of payment. Delivery times are indicative and do not engage the seller’s liability in the event of delays attributable to the carrier or exceptional circumstances (weather, strikes, etc.), without prejudice to the seller’s obligation to deliver within a maximum period of thirty (30) days.
Mainland France:
- Chronofresh home delivery: orders placed Monday to Friday before 12:00 pm are delivered within 24–48 hours, before 1:00 pm. Saturday delivery possible.
- DHL home delivery: orders placed Monday to Thursday before 12:00 pm, delivery within 24–48 hours. No Saturday delivery.
- Chronopost home delivery: orders placed Monday to Friday before 12:00 pm, delivery within 48 hours. Saturday delivery possible.
- Chronopost relay point: delivery within 24–48 hours. Maximum 13 bottles.
Corsica and International: delivery times vary by country: 2–5 days within the EU, up to 15 days outside the EU.
In all cases, delivery shall occur within a maximum of thirty (30) days from receipt of payment. If delivery cannot be made within this timeframe, the consumer may cancel the order and request an exchange or a refund.
8.3 – Liability
Products travel at the seller’s risk until delivery. The consumer must check the parcel upon receipt. Any damage or anomaly must be noted on the delivery slip, confirmed in writing to the carrier within 48 hours, and reported to the seller within the same timeframe, with supporting photos.
Alcohol sales to minors are strictly prohibited. By placing an order, the consumer certifies being at least 18 years old.
The seller’s liability is strictly limited to the amount of the order. Under no circumstances shall the seller be liable for indirect damages, including but not limited to loss of turnover, loss of profits, loss of use, loss of interest, or loss of business opportunities. This limitation of liability shall not apply in cases of personal injury, gross negligence, wilful misconduct, or where such limitation is prohibited by applicable law. Nothing in these General Terms and Conditions limits or excludes the consumer’s statutory rights under applicable law.
The seller complies with legal guarantees of conformity and hidden defects under French law, in particular Articles L217-3 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.
8.4 – Product Quality Degradation
In the event of cork taint or hidden defects, the consumer may request an exchange or refund under Articles 1641 et seq. of the French Civil Code. CAVE PUR JUS selects natural, artisanal wines. Natural variations (sediment, taste changes) do not constitute legal defects.
Temperature and Transport: For deliveries within France, CAVE PUR JUS offers a service via Chronofresh, ensuring that bottles are kept cool and thermal shocks are minimized. It is the consumer’s responsibility to choose whether or not to select this delivery method.
In the event of high temperatures, the use of temperature-controlled delivery (Chronofresh) is strongly recommended. CAVE PUR JUS cannot be held liable for any deterioration in the quality of the wine resulting from temperature variations if this mode of transport has not been selected.
For deliveries within Europe, transport via DHL or Chronopost is not temperature-controlled. The consumer may nevertheless choose to proceed with shipment or request, in the order comments, that dispatch be postponed to a period with more favorable climatic conditions (strongly recommended).
By choosing a non-temperature-controlled mode of transport, the consumer expressly acknowledges and accepts full responsibility for any potential deterioration in product quality resulting from temperature variations during transport. No claim may be made against CAVE PUR JUS on this basis.
No returns will be accepted without prior approval. The consumer must provide a description of the defect, together with the precise reference of the product concerned. CAVE PUR JUS does not cover damage resulting from improper use, impacts, or breakage due to professional use, in particular for glassware products.
8.5 – Shipping and Packaging Fees
Shipping fees vary depending on the number of bottles. 1 magnum counts as 2 bottles.
Note: Certain products (large formats, glassware) may affect the number of parcels and multiply shipping costs accordingly.
Delivery within France:
· Free shipping in mainland France for orders over €325 (excluding shipping fees). Free delivery also applies for exactly 16 bottles ordered (1 magnum counts as 2 bottles).
· Warehouse Pickup (Larmor-Plage, Morbihan): Free of charge.
· Chronofresh Home Delivery (mainland France only, excluding Corsica): Flat rate of €16.90 including VAT for 1–4 bottles, €19.90 for 5–9 bottles, €24.90 for 10–16 bottles, €29.90 for 17 bottles and more.
· DHL Home Delivery (mainland France only, excluding Corsica): Flat rate of €16.90 including VAT for 1–4 bottles, €19.90 for 5–9 bottles, €24.90 for 10–16 bottles, €29.90 for 17 bottles and more.
· Chronopost Home Delivery (mainland France only, excluding Corsica): Flat rate of €13.90 including VAT for 1–4 bottles, €15.90 for 5–9 bottles, €19.90 for 10–16 bottles, €24.90 for 17 bottles and more.

8.6 – Unclaimed Parcels
If a parcel is returned to us (not collected at the relay point within the allocated time), it may be reshipped provided the consumer pays the actual costs, namely:
· Return shipping fee: €10.25 including VAT.
· Reshipping fees (relay point or home delivery): calculated based on Chronopost rates applicable to the weight of the parcel, including fuel and security surcharges, and not according to the flat rate applied on the website at the time of the initial order.
8.7 – Insurance
Insurance costs are included in shipping fees unless otherwise stated.
Article 9 – Payment
9.1 – General Conditions
Full payment is required at the time of order by:

Available payment methods may vary depending on the consumer’s country.
9.2 – Payment Methods
1 – Online Payment: Secure Payment
We have implemented a secure payment procedure through MOLLIE. This process uses encryption technology, a recognized standard for secure payments.
How to place an order by credit card on the website:
When making your payment, you enter your credit card number and expiration date, which are immediately encrypted on your computer before being transmitted over the Internet. This ensures that no confidential information is transmitted over the network without prior encryption.
Important: Only credit cards displaying the CB, VISA, EUROCARD, or MASTERCARD logos are accepted. They must be part of the 3D Secure protocol. Otherwise, the payment will be refused, and you will need to use another payment method.
With Mollie, you also have access to other payment methods (Amex, Apple Pay), and depending on the country: Bancontact (Belgium), Klarna (Netherlands, Spain, Portugal, Norway, Germany, Italy, Ireland, France, Finland, Denmark, Belgium, Austria, Sweden), iDEAL (Netherlands).
2 – Bank Transfer

b) On the “Order Confirmation” page, please follow the instructions provided.
Any bank transfer fees, if applicable, are the responsibility of the consumer.
3 – PayPal
Payment via PayPal is also possible. To do so, select the PayPal payment option. You will then be redirected to the PayPal website, where you will need to log in and complete your payment on the PayPal platform.
4 – Scalapay: Interest-Free Payment in 3 Installments
Interest-free installment payments are available for orders of €150 or more. Consumers residing in the following countries can pay in 3 equal installments using Scalapay: France, Italy, Belgium, Germany.
The consumer will be redirected to the Scalapay platform to create an account or use an existing account. Payment is then made in three equal installments:
· First installment: at the time of the order
· Second installment: 1 month after the first installment
· Third installment: 2 months after the first installment
The order will be shipped after the first installment. Scalapay will notify the consumer of the upcoming installments via SMS. The consumer agrees to comply with Scalapay’s terms and conditions.
Article 10 – Right of Withdrawal
In accordance with Articles L221-5 et seq. of the French Consumer Code, the consumer benefits from a right of withdrawal when purchasing products online from the Cave Pur Jus website.
Before placing any order, Cave Pur Jus provides the consumer with all essential information regarding product characteristics, prices, payment methods, delivery terms, and contract execution, in accordance with Article L221-5.
Pursuant to Article L221-18, the consumer has a period of 14 calendar days from the receipt of the goods to exercise their right of withdrawal, without having to justify the reason for withdrawal and without incurring any costs other than those expressly provided for by law.
In accordance with Articles L221-6 and L221-8, Cave Pur Jus confirms to the consumer, in a clear and durable manner, the receipt of the order and the applicable contractual conditions, including the withdrawal policy. Under Article L221-12, the right of withdrawal is considered exercised once the consumer has communicated their decision before the expiration of the withdrawal period. This decision may take the form of a withdrawal form (see below) or any unambiguous statement expressing their intent.

According to Article L221-14, the costs of returning the products are borne by the consumer.
Finally, pursuant to Article L221-24, Cave Pur Jus undertakes to reimburse all sums paid (including the initial standard delivery costs) within 14 days of the effective receipt of the returned goods. The refund will be made using the same payment method used for the original transaction.
Article 11 – Retention of Title
Ownership of the goods remains with CAVE PUR JUS until full payment is received. Risk transfers to the consumer upon delivery.

Electronic records maintained by our IT systems under reasonable conditions shall be considered as evidence of communications, orders, and payments between the parties.
Article 14 – Protection of Minors
Ordinance No. 59-107 of January 7, 1959, and Law No. 74-631 of July 5, 1974 prohibit the sale and offering of alcoholic beverages to minors and equivalent persons. Consequently, by completing your Order Form and placing an order, you acknowledge that you have the legal capacity to enter into this contract.
Article 15 – Consumer Account Deactivation
In the event of non-compliance with the obligations arising from the acceptance of these General Terms and Conditions of Sale, payment issues for an order or subscription, the provision of incorrect information during account creation, or acts likely to harm the interests of CAVE PUR JUS, the company reserves the right to suspend access to the service or, depending on the severity of the acts, to terminate the member’s subscription and account without any claim for damages.
The company also reserves the right to refuse to enter into a contract with a consumer who has previously been excluded or sanctioned for such actions.
CAVE PUR JUS reserves the right to modify its terms of sale at any time. In such cases, the terms applicable will be those in force on the date of the consumer’s order.
Photos and product reviews are presented as accurately as possible. Differences in color or bottle presentation may result from photo quality or the date the photos were taken.
Article 16 – Opposition to Telephone Solicitation
In accordance with Article L223-2 of the French Consumer Code, the customer is informed that they may register for free on the BLOCTEL telephone solicitation opt-out list, available at: https://www.bloctel.gouv.fr/
This registration allows the customer to refuse to receive commercial phone calls from companies with which they do not have an ongoing contractual relationship.
CAVE PUR JUS undertakes to comply with this regulation and not to make unsolicited commercial calls to customers registered on this list, except in cases permitted by law (notably in the case of an existing contract or explicit customer request).
